Who is who
97 Studios builds your website. Your plan is billed by Magic Fresh LLC (Magic Fresh Cleaning), Romeoville, Illinois, through Square. The charge on your card statement will show Magic Fresh Cleaning.
The free preview
We build a preview of your website at no charge. It costs nothing and you owe nothing for it. We ask for a card on file when you request it so we can hold your spot and your price, and it is not charged for the preview. Nothing is billed until your site goes live and your free trial ends.
Your preview and changes
You see a preview as soon as you finish signing up. If you want changes, you can send up to 2 rounds of changes before launch, and we send you a final preview link by text and email within one business day of each round. Changes after launch are quoted before we start. A preview link works for 14 days, and we can send a new one if it has expired.
Launching
When you approve your site and choose a web address, we publish it within one business day. In these terms "one business day" means the next weekday, Monday to Friday, not counting public holidays, after we receive everything we need from you. Your free trial starts the day it goes live.
Your web address (domain)
If you ask us to get you a web address, we register it and pay the first year's registration fee. It is registered in our name and stays registered to us while your plan is active. It is transferred to you after your 12 months are complete, or when you buy out the site. If you cancel early, the site comes down and we keep the web address. If you already own a web address, you can use it instead. We send you simple steps to point it at your site, and it stays yours. Web address availability is checked in public records and confirmed when we register it.
Photos, logos and content
You confirm that you own, or have permission to use, every logo, photo and piece of text you send us, and that none of it breaks anyone's rights. You are responsible for what you send. We may remove anything we think is unlawful or unsafe.
Going live
Your site goes live when we publish it on your web address after you tell us to. A card on file is needed to go live, and your approval of the finished site is what tells us to publish.
Your 5 day free trial
Your 5 day free trial starts the day we deliver your finished site and it goes live. It does not start earlier, and nothing is billed before then. If you cancel before the trial ends, you pay nothing and there is no fee. We take the site down.
The 12 month plan
When the trial ends, we charge your first month of the plan you chose, plus a one-time $249 setup fee unless it was waived by a promotion shown on the page you signed up from. The plan then runs for 12 months from that first charge and is billed to your card each month.
Setup fee waiver
If your $249 setup fee was waived, it was waived because you agreed to the 12 month plan. That is why the early cancellation fee below is the same amount as the setup fee.
Early cancellation fee
If you cancel after the trial has ended and before the 12 months are up, you pay a one-time early cancellation fee of $249, charged to your card on file. After your cancellation takes effect you owe no further monthly payments.
There is no fee if you cancel before your site goes live, during the free trial, or after the 12 months are up.
After 12 months
The plan carries on month to month at the same price, and you can cancel any time with no fee.
How to cancel
Email contact@97studios.co or text (708) 378-7367 from the email or number you signed up with. We confirm your cancellation in writing. Billing stops after the month you have already paid for.
Card on file
If you save a card, it is not charged today. You authorize Magic Fresh LLC to charge it for your first month, the setup fee (unless waived), each monthly payment, and the early cancellation fee if it applies. Cards are handled by Square. We do not see or store your card number.
Promotions
Any promotion, such as a waived setup fee, applies only to previews requested before the end date shown on the page, and only if you approve your site within 30 days of requesting your preview. After 30 days the normal setup fee applies.
Free Contact page
If you choose the Starter plan and finalize your site on the same calendar day you request your preview (by midnight Central time), we add a free Contact page to your site. It stays part of your site while your plan is active. The Growth plan already includes a Contact page.
Hosting and changes
Hosting and security are included in your plan. If you want something changed, send it to us and we tell you the cost before we start.
What you own
Your business name, content, and photos stay yours. Taking the site files with you when you leave is available as a one-time buyout. Ask us for the details.
Results
We build the site and set up the basics so search engines can find it. We cannot promise a search ranking or a number of calls.
Our record of your agreement
When you tick the box we save the time, your IP address, your device, and the version of these terms you agreed to. We keep it so we both have proof of what was agreed. We also email you a copy of what you agreed to.
Changes to these terms
A new version applies to people who sign up after it is published. Your agreement stays as you accepted it.
Law
These terms are governed by the laws of the State of Illinois.
